Terms and Conditions (China)
These Terms and Conditions (“Terms”) govern your access to and use of the GForce Freight application, website, and related services (collectively, the “Services”) provided by GForce Freight (“Company,” “we,” “us,” or “our”). By accessing or using the Services within the People’s Republic of China (“PRC”), you agree to be bound by these Terms.
If you do not agree to these Terms, you must not use the Services.
1. Scope of Services
GForce Freight provides digital logistics and freight management services, including but not limited to shipment coordination, documentation, tracking, proof of delivery, and operational communication. The Services are intended for commercial and business use.
2. Eligibility
You represent and warrant that:
You are at least 18 years old;
You have the legal authority to enter into binding agreements under PRC law;
You are using the Services for lawful commercial purposes.
3. Account Registration and Responsibility
To access certain features, you may be required to create an account. You agree to:
Provide accurate and complete information;
Maintain the confidentiality of your login credentials;
Be fully responsible for all activities conducted under your account.
GForce Freight is not liable for losses resulting from unauthorized account access due to your failure to safeguard credentials.
4. Use of the Services
You agree not to:
Use the Services for illegal, fraudulent, or unauthorized purposes;
Upload false, misleading, or unlawful information;
Interfere with or disrupt system security or operations;
Violate applicable PRC laws, regulations, or public order.
We reserve the right to suspend or terminate access if misuse is suspected.
5. Data Collection and Privacy
Your use of the Services is subject to our Privacy Policy, which complies with applicable PRC data protection laws, including the Personal Information Protection Law (PIPL), Cybersecurity Law, and Data Security Law.
By using the Services, you consent to the collection, processing, storage, and use of personal and operational data as described in the Privacy Policy.
6. Camera, Media, and Documentation
The Services may require access to device features such as the camera to capture shipment images, documents, or proof of delivery. All media collected:
Is used solely for freight operations, compliance, and recordkeeping;
Is processed in accordance with applicable laws and our Privacy Policy;
Will not be used for advertising or unrelated purposes.
7. Intellectual Property
All content, software, trademarks, logos, and materials related to the Services are owned by or licensed to GForce Freight and are protected under PRC intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the Services solely for their intended purpose.
8. Third-Party Services
The Services may integrate with third-party platforms or service providers. GForce Freight is not responsible for third-party content, systems, or actions. Your use of third-party services is subject to their respective terms.
9. Service Availability and Modifications
We may modify, suspend, or discontinue any part of the Services at any time due to operational, legal, or regulatory requirements. We do not guarantee uninterrupted or error-free operation.
10. Limitation of Liability
To the maximum extent permitted by PRC law:
GForce Freight shall not be liable for indirect, incidental, or consequential damages;
Our total liability shall not exceed the fees paid by you for the Services in the preceding twelve (12) months.
Nothing in these Terms excludes liability that cannot be excluded under PRC law.
11. Indemnification
You agree to indemnify and hold harmless GForce Freight from any claims, damages, losses, or expenses arising from:
Your misuse of the Services;
Your violation of these Terms or applicable laws;
Your submission of unlawful or inaccurate information.
12. Termination
We may terminate or suspend your access immediately if you violate these Terms or applicable laws. Upon termination, your right to use the Services will cease.
13. Governing Law and Dispute Resolution
These Terms shall be governed by the laws of the People’s Republic of China.
Any dispute arising from or relating to these Terms shall first be resolved through friendly consultation. If consultation fails, the dispute shall be submitted to the competent people’s court in China with jurisdiction.
14. Updates to Terms
We may update these Terms from time to time. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
